Ocean Trail Subdivision is a standard single-family home HOA in Wilmington, NC. These restrictive covenants run with the land and bind all lot owners, governing what you can build, how you use your property, and what you must maintain.
- What you can build: Only one detached single-family dwelling (max 2.5 stories), a garage or carport (max 3 cars, no living quarters), and one storage building (max 20% of dwelling square footage, must be behind the house). Minimum dwelling size is 1,000 sq ft (excluding porches/garages). Double-wide or modular homes must meet specific size, roof, foundation, and removal of transport features.
- Setbacks & location: Front setback: 25 ft from front property line; side street setback: 10 ft; side lot line setback: 5 ft. Overhangs up to 3 ft and uncovered stoops/steps are allowed within setbacks. If you own two adjoining lots, the boundary between them is not considered a side lot line.
- Architectural review: All building designs (including storage buildings, detached garages, dog houses, and additions) must be approved by the Developer (or designee). Submit plans; approval or disapproval must be given within 10 days, otherwise approval is not required. Designs must be in harmony with existing structures.
- Exterior materials & appearance: Dwellings must be wood, brick veneer, concrete block with brick veneer, vinyl siding, composition board, or other approved synthetic material. Detached structures must match the main dwelling's materials, color, and general appearance. All houses must be well maintained, cleaned, and painted.
- Fences: Fences cannot exceed 6 ft in height and must not extend nearer the street than the front setback line. All fences must be approved by the Developer as to design, height, type, and appearance. No chain-link fences within view of any street.
- Property maintenance & nuisances: Keep your lot neat, tidy, and landscaped. Store bicycles, equipment, trash cans, gas bottles, etc. out of street view. No statues, sculptures, yard decorations, or artificial wildlife. No noxious trades or nuisances. Junk cars, inoperative machines, and unfinished mechanical work (max 3 days) are prohibited. Yards must be maintained; if not, the Developer may clean up at owner's expense.
- Parking & vehicles: Max 3 motor vehicles per home, all licensed and in good running order. Boats, RVs, semi-trucks, and similar vehicles may not be parked in front/side yards or on the street; they must be in the back yard. No mechanical work in front/side yards or within street view; only in back yards or garage.
- Pets: Only household pets allowed, not for commercial breeding. Pets must be kept inside, in an approved fenced area, or on a leash.
