This document is a collection of deeds and a declaration of restrictions for the Audubon Subdivision and Section D of South Oleander in Wilmington, NC. - Property use & building type: Lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories) and a one- or two-car garage are allowed per lot.
- Setbacks & lot subdivision: Buildings must be at least 50 feet from the front street line and 10 feet from side property lines. Lots cannot be re-subdivided unless the subdivided part merges with an adjacent lot.
- Temporary & accessory dwellings: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence before the main house is built. Afterward, only a garage apartment of good construction and design is allowed, subject to approval.
- Architectural review: Building designs must be approved by the developer or a committee. If no decision within 10 days of written request, approval is not required if the design is in harmony with existing structures. All dwellings must have at least 1,750 sq ft interior area (excluding porches and garages) and be built of wood, brick, brick veneer, tile and stucco, or concrete and stucco. Garages must match the dwelling's materials.
- Sewage & drainage: Until municipal sewerage is available, septic tanks must meet state health board approval. If gutters and curbstones are not installed, each owner must install and maintain adequate culverts under their driveway to maintain natural drainage.
- Enforcement & severability: Any property owner in the subdivision may sue to enforce these restrictions or recover damages. If any restriction is invalidated by court order, the rest remain in effect.
