Sounds Edge at Bradley Creek is a standard single-family home subdivision in Wilmington, NC. The document establishes a homeowners association (HOA) that maintains private roads and common areas, funded by assessments on each lot.
- Permitted uses & building restrictions: All lots are for single-family residential use only. No business, trade, or occupation is allowed on any lot. No more than 9,980 square feet per lot (including right-of-way) may be covered by structures or paved surfaces. Minimum dwelling size is 2,500 square feet of enclosed area. Modular, prefabricated, and previously constructed houses are prohibited.
- Architectural review: No building, fence, wall, or other structure may be erected or altered without written approval from the Declarant (or later the HOA). Approval may be based on any ground, including aesthetics. Plans are deemed approved if not rejected within three weeks of submission. Exterior materials are limited to conventional frame, brick, clay brick, or stucco; vinyl, aluminum, and asbestos siding are banned. All driveways and parking areas must be paved. Garages must have side entry (except Lot 9). Fences: max 6 feet on side/rear, 4 feet in front, and no fences closer to the front lot line than the front of the residence.
- Vehicles & parking: No inoperative junk cars, large trucks, buses, or recreational vehicles may be stored on any lot. Boats, campers, trailers, and similar vehicles are not permitted on lots or streets without written consent. All driveways and parking areas must be paved.
- Pets & animals: Only non-violent domesticated household pets are allowed. No farm animals or fowl. Pets must be leashed or otherwise secured when outside the owner's lot.
- Signs & antennas: Only one 'For Sale' or 'For Rent' sign (max 5 sq ft) is allowed per lot. No other signs or billboards are permitted. No outside radio/TV antennas or satellite dishes without written approval.
- Nuisance & maintenance: No noxious or offensive activities. Each owner must keep their lot mowed and clear of unsightly objects. The Declarant (or HOA) may enter and clean/mow at the owner's expense if not done. No yard or garage sales. Garbage receptacles must be screened from view. Exterior lights must be clear, white, or non-frost. No exposed fuel tanks. All utilities must be underground.
- HOA assessments & membership: Every lot owner is a member of the Sounds Edge Homeowners Association. The HOA may levy annual and special assessments to maintain private roads, common areas, and street lighting. Assessments are a lien on the lot and a personal obligation of the owner. Delinquent assessments bear 10% annual interest and may be collected via lawsuit or foreclosure. No initial assessments are set until at least 50% of lots are sold. Once control passes to owners, each lot has one vote; a quorum is 65% of votes, and decisions require a majority.
