What Summers Glen's governing documents say
Summers Glen is a single-family home subdivision in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The rules focus on maintaining the residential character and appearance of the neighborhood.
- Residential use only: All lots are for single-family residential purposes only. No house trailers, mobile homes, tents, or temporary structures may be used as residences.
- Minimum house size: Each residence must have at least 950 square feet of heated floor space, excluding porches, steps, walks, carports, and storage areas. The Declarant may approve a dwelling up to 10% smaller.
- Exterior materials & design: Exterior materials are limited to conventional frame, brick, clay brick, stucco, vinyl, or exterior composition sidings. Concrete block, concrete brick, asbestos siding, aluminum siding, cinder block, and tar paper composition are prohibited. Roofs must have a minimum pitch of 6/12 unless waived by the Declarant.
- Architectural & site approval: All building plans, site locations, fences, and hedges require prior written approval from the Declarant. No lot may be clear-cut without consent. Chain link fences are prohibited.
- Parking & vehicles: Each lot must have a paved driveway and off-street parking for at least two cars. Inoperable vehicles, campers, trailers, trucks over one ton, and similar vehicles are not allowed unless stored out of sight or with written permission. No school buses may be parked on streets, lots, or common areas.
- Pets & nuisances: No domesticated farm animals or fowls may be kept. No noxious or offensive activity is allowed. Yards must be properly maintained; unsightly junk cars and eyesores are prohibited.
- Signs, mailboxes & utilities: Only one 'for sale' sign (max 5 sq ft) is allowed. Each lot may have one mailbox and one paper box on a single post, approved by the Declarant. Fuel tanks, clothes lines, wood piles, and trash must be screened from view. Water must come from the community system; sewage must connect to the community treatment system.
- Amendments & duration: The Declarant may amend these restrictions while it owns a lot; thereafter, amendments require a vote of 2/3 of lot owners. The covenants run for 20 years from the date of the declaration (1995) and automatically renew for successive 10-year periods unless a majority of lot owners agree to change them.
