George C. Lewis Subdivision is a standard single-family home HOA in Wilmington, NC, with 18 lots. These restrictive covenants run with the land and bind all current and future owners, not a separate association.
- Residential use only: All lots must be used for residential purposes only. No trailers or mobile homes are allowed as residences, even temporarily.
- Minimum home size: Dwellings must have at least 1,200 square feet of living space, excluding porches, garages, carports, and storage areas.
- Architectural review: Plans for all dwellings and structures must be approved by the developers (or their successors). If no response is received within 20 days, plans are deemed approved as long as they are in general conformity with other structures in the subdivision.
- Permitted structures: Only detached single-family dwellings and small accessory buildings or detached private garages are allowed. Garage apartments and temporary residences are prohibited.
- Setback requirements: Buildings must be at least 40 feet from the front property line and 15 feet from side boundary lines. If two or more lots are combined for one residence, interior boundary lines are disregarded. Unintentional violations may be adjusted with adjacent owner consent, up to 10% of the required setback.
- Nuisance and animals: No noxious or offensive activities, no domesticated farm animals, and no unsightly or inoperative junk cars. Yards must be maintained at owner's expense.
- Tree preservation: Trees larger than 15 inches in caliper that are not in the way of a proposed structure, driveway, patio, or sidewalk (or within 10 feet of them) may not be cut unless unsightly, unsound, hazardous, or detrimental. This does not prevent gardening or planting.
- Duration and amendment: These restrictions run for 20 years from May 1982 and automatically extend unless a majority of lot owners vote to revoke or amend. Amendments require a written document executed by owners of a majority of lots.
