El Ogden is a single-family home subdivision in Wilmington, NC, governed by a 1973 Declaration of Restrictions. These rules apply to all lot owners and are designed to maintain a uniform residential character.
- Land use & building type: All lots are for single-family residential use only. No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences.
- Minimum house size: Residences must be at least 1,000 square feet, measured by exterior brickwork, excluding porches, steps, walks, garages, carports, and storage areas.
- Setbacks & lot lines: Buildings must be at least 30 feet from the front property line and no closer than 10% of the lot's front width to any side boundary line.
- Signs: No signs or billboards are allowed except private name plates, resident identification signs, and 'For Rent' or 'For Sale' signs.
- Nuisances & prohibited activities: No noxious or offensive trades or activities. No domesticated farm animals or fowls. No unsightly inoperative junk cars or similar eyesores.
- Easements & maintenance: Utility and drainage easements are reserved over the rear 10 feet of each lot and as shown on the plat. Lot owners must maintain the easement area and improvements, except those maintained by a public authority or utility.
- Architectural review: Building designs must be approved by the Developer (or its nominee). Plans are deemed approved if no action is taken within 10 days of a written request.
- Duration & amendment: These restrictions run for 25 years from 1973, then automatically renew for successive 10-year periods unless a majority of lot owners vote to revoke or amend them.
