Dolphin Bay is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This document is the original 1983 declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lots in Section 1 (Revised) and future phases. It establishes rules for residential use, architectural control, and mandatory HOA membership with assessments for common areas like roads, a pool, clubhouse, fishing pier, and boat docks.
- Property type & use: Lots are for single-family residential use only, except Lot 5 which may remain a duplex. No business, trade, or occupation is allowed on any lot.
- Architectural review: All buildings, fences, and other structures require prior written approval from the Company or an Architectural Control Committee. Minimum dwelling size: 1,250 sq ft for one-story, 1,000 sq ft on first level for multi-story. Exterior materials must be wood, brick, or stucco; no concrete block, aluminum siding, or tar paper. Trees over 5 inches in diameter (measured 1 ft above ground) may not be removed without approval.
- Pets: Only domesticated pet dogs, cats, and birds are allowed. Pets must be kept inside, in an approved fenced area, or on a leash when outside.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars. Curb-side parking is not allowed. Boats not in slips must be stored in carports or driveways.
- Leasing & rentals: The document does not address leasing or rental restrictions beyond allowing tenants to use common areas as guests.
- Assessments & HOA fees: Annual assessments began at $150 per lot in 1984. The Board may increase assessments up to 10% per year without member vote; higher increases require a two-thirds vote. Special assessments for capital improvements also require a two-thirds vote. Assessments are a lien on the lot and a personal obligation of the owner.
- Common areas & amenities: Owners have easements to use the swimming pool, clubhouse, fishing pier, gazebo, and boat basin. Boat slip owners pay an additional annual assessment equal to the general assessment for dock maintenance. All common area costs are shared via assessments.
