Cassimir Commons is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). All lot owners are automatically members of the Cassimir Commons Association, Inc., which maintains common areas and enforces the rules. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land and bind all owners, tenants, and occupants.
- What you own & maintain: You own your building lot and the house on it, and you are responsible for maintaining all improvements on your lot (interior and exterior). The Association maintains the common areas, including roadways, walkways, plantings, and lighting.
- Architectural review: No building, exterior alteration, or painting may begin without written approval from the Declarant (developer) or later the Association's Architectural Control Committee. Plans must be submitted; approval may be based on aesthetic grounds. If no response within 30 days, approval is deemed given.
- Minimum house size: Each house must have at least 1,100 square feet of enclosed dwelling area (excluding garages, decks, porches, etc.).
- Use restrictions: Lots are for single-family residential use only. No temporary structures, trailers, or mobile homes as residences. No inoperable or unregistered vehicles; no boats, campers, or recreational vehicles unless stored out of sight in a garage. No 'For Sale' signs. No outside antennas without permission.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed and escorted when outside and not allowed to run free.
- Assessments & fees: Annual assessments are set by the Board and were initially $65 per lot per month. They can increase up to 5% per year without a membership vote; larger increases require a 2/3 vote. Special assessments for capital improvements also require a 2/3 vote. A working capital fee equal to two months' estimated dues is due at closing.
- Leasing & rentals: The document does not restrict leasing or set minimum lease terms. However, all tenants must comply with the CC&Rs.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars, with concrete driveways and parking areas. No parking on common driveways or turn-around pads. Inoperable or unregistered vehicles may be towed at owner's expense.
