What Creekside Yacht Club's governing documents say
Creekside Yacht Club is a private yacht club community in Wilmington, NC, centered around a marina, dry stack boat storage, and a clubhouse. Membership is tied to ownership of a Boat Slip, not a residential unit. This document establishes the covenants, conditions, and restrictions governing the club and its members.
- Membership & Boat Slips: There are two membership classes: Charter (held by the developer) and Class A (each tied to one specific Boat Slip). Class A members have exclusive use of their assigned slip and non-exclusive use of common areas. Charter memberships are freely transferable; Class A memberships are subject to a right of first refusal in favor of the Association.
- Assessments & fees: Class A members pay regular and special assessments. Special assessments over $1,000 per membership in a fiscal year require a majority vote of members. The Association may also levy assessments for rule violations (up to $500 per occurrence) and for damage caused by a member's fault. Delinquent assessments accrue interest at 18% per annum and become a lien on the membership.
- Marina & Use Restrictions: The marina is a 'closed-head, non live-aboard' facility. All rights are subject to federal and state permits. Members may delegate their common area rights to family, guests, tenants, or contract purchasers.
- Transfer & Right of First Refusal: Class A members must give the Association a right of first refusal on any sale. The Association has 30 days after receiving a signed contract to match the offer. This right terminates 21 years after the declaration is recorded, or earlier if the Association decides.
- Voting Rights: Each Class A membership and each Charter membership has one vote. A quorum requires 60% of all votes eligible to be cast.
- What this document doesn't cover: This document does not address residential use, age restrictions, pets, leasing of units, or architectural review. It governs only the yacht club membership and common areas, not any residential property.
