Bradley Hills is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all residential lots and are enforced by the original developer (TQI) and later by lot owners. The covenants cover architectural approval, minimum house size, construction deadlines, and use restrictions.
- Architectural review: No building, fence, wall, or other structure may be erected or altered, and no grading or vegetation removal (trees over 3 inches in diameter) may occur, without prior written approval from TQI. Approval may be based on any ground, including aesthetic considerations, in TQI's sole discretion.
- Minimum house size: Each house must have at least 1,500 to 2,500 square feet of enclosed dwelling area (excluding garages, decks, open porches, and shed-type porches). If the deed does not specify a minimum, the default is 2,000 square feet.
- Construction deadlines: A house must be completed and a certificate of occupancy issued within three years of the deed from TQI. Exterior completion must occur within 12 months of construction start, unless delayed by strikes, fires, national emergency, or natural calamity. If not completed, TQI has an option to repurchase the lot at the original price.
- Residential use only: All lots are for residential purposes only. No home business or occupation is permitted. No trailers, tents, or temporary structures may be used as residences.
- Pets: Only household pets are allowed; no other domesticated animals may be kept on the property.
- Parking & vehicles: Each lot must provide off-street parking for at least three passenger cars, with driveways and parking areas made of concrete, asphalt, or crushed stone.
- Signs: Only a temporary 'For Sale' sign and a property identification sign (combined total of 2 square feet) are allowed.
- Right of first refusal: For two years after buying a lot, the owner must first offer it to TQI at the same price and terms before selling to anyone else. TQI has 30 days to accept or reject.
