- What you own & maintain: You own your lot and the house on it. The association maintains the common areas, including the Rec Area, pedestrian/golf cart easement, and the boat slips and pier. You must maintain your own lot and keep it clean and tidy.
- Use restrictions: Lots are for single-family residential use only. Business activities are prohibited unless they are home offices that don't create visible signs, regular client visits, or nuisances. No temporary structures (except contractor shelters during construction), no noxious activities, and no signs except small 'For Sale' signs (max 6 sq ft), owner ID signs (max 2 sq ft), and temporary political signs (removed within 48 hours after polls close).
- Pets: Only domesticated pet dogs, cats, and birds are allowed. No other animals may be kept on any lot.
- Architectural review: All structures, fences, walls, mail receptacles, and any changes to grade or vegetation require prior written approval from the Declarant (or its assignee). Minimum enclosed dwelling area is 2,000 square feet. Houses must be wood, stone, brick veneer, tile, stucco, or concrete/stucco. No trees over 5 inches in diameter (measured 1 foot above ground) may be removed without approval.
- Parking & vehicles: Each lot must provide off-street parking for at least 3 passenger cars. Parking areas and driveways must be asphalt, crushed stone, crushed shells, or other approved material.
- Boat slips: Seven boat slips are assigned to specific lots (e.g., Lots 1 & 2 get Slip 5, Lot 3 gets Slip 6, etc.). Slips may be traded or sold only to other Legacy Pointe lot owners. They cannot be rented to non-owners. The privilege to use the easement and slips may be delegated only to family, guests, or tenants of the lot.
- Assessments & fees: Annual assessment is $1,500 per boat slip owned, or per lot if no slip is owned. If you own two lots and one slip, you pay one annual assessment. A one-time capital contribution of $1,000 per lot is due at closing. Assessments can increase up to 10% per year without member vote; larger increases require a 2/3 vote. Special assessments for capital improvements also require a 2/3 vote. Assessments are due monthly and bear 10% interest if unpaid after 30 days.
- Stormwater restrictions: Maximum built-upon area per lot is 7,000 square feet. All runoff must drain into the permitted stormwater system. No alteration or filling of stormwater control measures is allowed, and no fences or structures are permitted within private stormwater easements.
