Wrightsville Green is a single-family home HOA in Wilmington, NC. This document is the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that binds all lot owners, tenants, and occupants. It sets rules for land use, assessments, architectural control, and common area access.
- What you own & maintain: You own your lot and the single-family dwelling on it. You must maintain the yard and exterior of your home. The HOA maintains the common areas (e.g., private streets, amenities) and can enter your lot for maintenance if you fail to keep it up.
- Assessments & fees: Annual assessments start when your lot becomes a 'Lot in Use' (house built and occupied). The initial maximum annual assessment was $480 per lot in use (1987), adjustable annually by the Board up to 5% or CPI increase. Special assessments for capital improvements require a 2/3 vote of members. A working capital fee equal to two months' estimated assessment is due at closing.
- Leasing & rentals: Leases must be for at least 30 days to prevent short-term rentals. Owners may delegate common area use rights to tenants who reside on the property.
- Architectural review: All exterior changes (buildings, fences, walls, color changes, yard plantings, mailboxes) require prior written approval from the Board or an architectural committee. Plans are deemed approved if no decision is made within 30 days of submission. Minimum house size is 1,200 square feet of enclosed dwelling area (excluding garages, decks, porches).
- Use restrictions: Lots are for single-family residential use only. No businesses, no temporary structures as residences, no inoperable or unregistered vehicles, no boats or campers unless stored out of sight. Pets (dogs, cats) are allowed but must be leashed and not a nuisance; excessive barking is a nuisance.
- Common area & amenities: All lot owners have an easement to use the common areas (including recreational facilities). Use can be suspended for unpaid assessments or rule violations (up to 60 days). Guests must be accompanied by an owner.
- Developer rights & phase annexation: The developer (Declarant) reserved the right to add contiguous property to the HOA until January 1, 1999, without owner vote. The developer also had weighted voting (Class B) until that date or until Class A votes equaled Class B votes.
