What Ervin's Place's governing documents say
Ervin's Place is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all lot owners and are designed to preserve property values and neighborhood appearance.
- Residential use only: All lots must be used for residential purposes only. No commercial use is allowed, and only one residence per lot is permitted. Lots cannot be subdivided.
- Architectural review: All home plans must be approved by the Developer, who can reject plans that do not comply with their vision or enhance the subdivision.
- Building specifications: Dwellings must be detached single-family homes, no more than 2.5 stories, with a minimum of 900 square feet (excluding porches, garages, etc.). Homes must have a brick foundation, a minimum 10-foot-wide concrete driveway, and at least 36 inches of crawl space. All homes must be situated parallel to the street.
- Setbacks: No building may be nearer than 30 feet to the front property line, nor nearer than 10% of the lot's front width to any side boundary line. Owners of combined lots may disregard interior boundary lines for setback purposes.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed or under control at all times and must not become a nuisance. No domesticated farm animals or fowl are permitted.
- Vehicles and storage: No inoperable vehicles or vehicles without current registration and insurance are allowed on any lot. No fuel tanks or similar storage receptacles may be exposed to view; they must be installed inside the dwelling, an accessory building, a screened area, or buried underground.
- Maintenance and nuisances: Owners must maintain their yards and prevent unsightly conditions, including inoperative junk cars. No noxious or offensive trade or activity is allowed. Wood or vinyl fencing is permitted in the rear yard only with Developer approval.
- Duration and amendments: These covenants run with the land for 20 years from March 2001, automatically renewing for successive 10-year periods unless a majority of lot owners vote to revoke or amend them. Amendments may be made at any time by a majority vote of lot owners.
