What Beach View Townhouses's governing documents say
Beach View Townhouses is a small townhome community in Wilmington, NC, with just two units in a single building. The rules bind unit owners and occupants, and the association maintains common elements. This is a full set of governing documents (Declaration, By-Laws, and Rules and Regulations).
- What you own & maintain: You own your individual townhouse unit and an undivided one-half interest in the common elements. You are responsible for all maintenance and repairs inside your unit, including structural items. The association maintains all common elements (land, roads, utilities, etc.) as a common expense.
- Use restrictions: Units may only be used for single-family residential purposes. No single rooms may be rented; only the entire unit may be leased. No use that is a source of annoyance to residents is permitted.
- Leasing & rentals: Leases are allowed only for the entire unit (not individual rooms). Before selling or leasing, all unpaid assessments must be paid in full.
- Architectural review: No structural addition, alteration, or improvement may be made to a unit without prior written consent of the Board of Managers. The Board must respond within 30 days; failure to respond constitutes consent. Exterior decorations also require Board approval.
- Assessments & fees: The Board determines annual common charges based on a budget. Unpaid assessments accrue interest at the legal rate and create a lien on the unit. The association may foreclose on the lien or sue for unpaid charges.
- Parking & vehicles: No boats, trailers, bicycles, or similar vehicles may be left in common areas or streets without Board consent. Vehicles must not impede access to other units. Owners must obey posted parking and traffic regulations.
- Insurance: The association carries master insurance on common areas at 100% replacement cost. Each unit owner must also insure their own unit for replacement cost and provide proof to the Board upon request.
- Pets: The document does not mention any pet restrictions.
