Sound Gardens Yacht Club is a boat-slip membership community in Wilmington, NC — you don't own land or a home; you own a Boat Slip License that gives you exclusive use of a boat slip and membership in the association, which maintains the docks, common areas, and facilities. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that governs all members, their lessees, and guests.
- What you own & maintain: You own a Boat Slip License, which gives you exclusive use of a specific boat slip and a membership in the association. The association maintains all common areas, bulkheads, docks, piers, pilings, and performs maintenance dredging. You are responsible for your own boat and personal property.
- Leasing & rentals: You may lease your boat slip only with prior board approval (which cannot be unreasonably withheld). Leases must require the lessee to follow all governing documents. The board may adopt a lease application procedure. You cannot allow any boat other than your own or your lessee's to occupy your slip.
- Boat slip use & restrictions: Boats in slips cannot exceed 24 feet in length or extend beyond the slip. No electric lifts are allowed. Long-term or major boat maintenance is prohibited; minor maintenance lasting more than three days needs board approval. No junk boats, fireworks, or release of refuse/oil/gasoline into the water. Members must remove boats in inclement weather when required by the board.
- Transfer & resale: Before selling your membership, you must first offer it to the declarant (or association if declarant no longer exists) at the same price and terms as the highest bona fide offer. The offer must remain open for 30 days. Any sale, transfer, or lease without complying with this article is voidable by the declarant or association.
- Assessments & fees: Each membership pays general assessments set by the board at a uniform rate for all slips. Special assessments over $100 per year require a majority member vote, except those for sewer, drainage, or dock facility maintenance required by permits. A one-time working capital fee of $200 is due upon acquiring a license. Delinquent assessments become a lien on the membership and may be foreclosed.
- Enforcement & penalties: The association can suspend voting rights and use of common areas and boat slip for up to 60 days per rule violation, impose fines (which become individual assessments if unpaid after 15 days), and remove boats during suspension at the owner's expense. Lessees' violations also subject the member to penalties.
- Architectural review: No building, fence, wall, sign, or other structure may be built or altered on common area or association property without written approval from the board or an architectural committee of three or more board representatives.
- Parking & guests: Parking is allowed only in designated areas determined by the board. The board may limit the number of guests. Use of the boat dock facility and common areas is limited to members, their families, guests, and lessees.
