Westgate Townes is a townhome subdivision in Bolivia, NC, governed by a homeowners association (HOA). Each owner owns a lot and a townhome unit, with shared party walls between units. The HOA maintains common areas and provides exterior maintenance for townhomes, while owners are responsible for interior maintenance and watering their lots.
- What you own & maintain: You own your lot and townhome unit. The HOA maintains roofs, gutters, exterior surfaces, trees, shrubs, grass, walks, and other exterior improvements, but not glass surfaces or fenced areas. Owners must water their own lots and are responsible for interior maintenance and repairs.
- Leasing & rentals: Leases must be in writing, for a minimum term of three months, and for residential purposes only. No portion of a residence may be leased separately. Transient housing, hotel use, and bed-and-breakfast operations are prohibited.
- Pets: No more than three domestic dogs or cats per lot are allowed, subject to HOA rules. Pets must not be kept for commercial purposes or breeding, and any pet causing a nuisance or unreasonable disturbance must be removed upon ten days' written notice. Pets must be leashed or carried in common areas.
- Parking & vehicles: No boats, campers, trailers, motor homes, or unlicensed vehicles may be kept on a lot outside a garage unless approved by the HOA. No parking on grass or landscaped areas. Street parking is allowed only for deliveries or commercial duties. No basketball goals in street rights-of-way.
- Architectural review: All alterations, constructions, or improvements on lots require approval from the HOA's architectural committee. Fences must be white vinyl, no taller than six feet, and not closer to the street than the rear corner of the house. No chain-link, wire, or concrete block fences are allowed.
- Assessments & fees: All lot owners pay annual assessments for common expenses, plus possible special assessments for capital improvements, insurance, and ad valorem taxes. Assessments are uniform per lot. Delinquent assessments accrue interest at 18% per annum and may become a lien on the lot.
- Use restrictions: Lots are for residential use only; no business or commercial activities are allowed. Group homes are prohibited. No noxious or offensive activities, no burning of rubbish, and no window air conditioners. Temporary structures and antennas (except small satellite dishes per FCC rules) are not allowed.
