This is a Declaration of Restrictive Covenants for Seaside Bay (formerly Doe Creek Plantation), a single-family residential subdivision in Bolivia, NC. It creates a homeowners' association (Seaside Bay Homeowner's Association, Inc.) and sets rules that apply to all lot owners, residents, and their guests.
- Land use & building restrictions: Each lot is for permanent single-family residential use only. Minimum 1,200 sq ft of heated floor space. No mobile homes, trailers, or temporary housing as permanent residences. Only one dwelling per lot. No more than 4,300 sq ft of impervious surface per lot. Setbacks: 5 ft side, 25 ft front, 9 ft rear.
- Construction & exterior standards: Exterior construction must be completed within 1 year of starting. Landscaping/grassing must be done within 1 year of construction start. Siding must be wood, stone, brick, hardiplank, or similar natural material – no metal, tar paper, asbestos, or unfinished plywood. No outbuildings except a detached garage and one small storage building matching the residence.
- Pets: No commercial breeding. Up to 5 usual household pets (dogs, cats) allowed per lot, must be confined to the lot or on a leash outside. No animal that frequently disturbs neighbors.
- Vehicles & parking: Parking on subdivision roads or rights-of-way is prohibited. All driveways and parking areas must be surfaced with gravel, concrete, asphalt, or similar. No unlicensed or inoperable vehicles. No more than one boat trailer outside an enclosed garage; if outside, must be tagged, titled, and in working order.
- Leasing & rentals: Leasing or renting of dwellings is allowed for any length of time. Lodging businesses (short-term rentals) require Declarant approval in its sole discretion. In-home businesses that don't invite the general public are allowed.
- Common areas & amenities: The association maintains private roads, entrance, ditches, drainage, and stormwater structures. There is a common boat launching area and piers for lot owners and guests. No boat may be moored unattended for more than 12 hours; no boat trailers parked overnight. Private piers allowed by state permit, max 6 ft wide, elevated at least 3 ft, with 15 ft setback from property lines.
- Assessments & fees: Annual assessment of $400 per lot for road and common area maintenance. Assessments due 30 days after notice; delinquent assessments bear 18% annual interest and can become a lien on the property. Association may also levy additional assessments as needed.
- Signs & antennas: No signs visible from public view except owner name/address, property for rent, or for-sale signs with Declarant's permission. No antennas larger than 18 inches in diameter without Declarant's written approval.
