What Caswell Dunes's governing documents say
This document is a Declaration of Covenants, Conditions, Easements, and Restrictions for Ryder Cup Way, a single-family home community within the larger Caswell Dunes development in Bolivia, NC. It binds all lot owners and occupants, but owners are not members of the Caswell Dunes condominium association. The declaration establishes an association (Caswell Dunes, Inc.) that manages common areas and enforces rules, but does not provide membership or insurance for owners.
- What you own & maintain: You own your lot and dwelling unit. The association mows the lawn on each lot but does not maintain any other improvements on the lot (e.g., decks, patios, driveways). You are responsible for upkeep of your lot and dwelling unit consistent with the 'Community-Wide Standard' set by the association.
- Assessments & fees: The initial annual assessment is $2,400 per lot, adjusted annually based on changes to Caswell Dunes member dues, but cannot increase more than 10% in any year. Special assessments may also be levied. Unpaid assessments become a lien on the lot.
- Leasing & rentals: Leases for less than 90 consecutive days require prior written consent from the association. All leases must be in writing, include tenant compliance with governing documents, and a copy must be provided to the association before occupancy. Only the dwelling unit may be leased; no separate leasing of fractions or other structures.
- Architectural review: No exterior improvements, alterations, landscaping changes, or painting may occur without prior approval from the Architectural Review Board (ARB) and the association. Plans must be submitted and approved; approval expires if construction doesn't start within 60 days or is not completed within the set period.
- Use restrictions & rules: The association may adopt and amend rules regulating use of common areas, parking, and other matters. Owners must comply with the declaration, the Caswell Dunes Documents, and any rules. Violations may result in fines, suspension of privileges, or other sanctions after notice and hearing.
- Parking & vehicles: Boats, trailers, campers, and non-automobile vehicles may only be parked in designated carports or garages if fully contained. Overnight parking of such vehicles elsewhere is prohibited without consent. Low-speed vehicles (LSVs) must comply with local ordinances and safety requirements.
- Pets: Pets are permitted on the grounds but must be leashed or carried. No pets (except service animals) are allowed in the enclosed pool area or water. Pet waste must be picked up and disposed of properly. Pet fencing (visible or invisible) and dog housing are not allowed.
