- What this document covers: This declaration creates a stormwater association to manage and maintain stormwater drainage systems, detention/retention ponds, and other improvements required by the North Carolina Division of Water Resources Stormwater Permit No. SW8 060721. It applies to all parcels within the medical park.
- Assessments & fees: Annual assessments are calculated per acre owned (including fractional acres) and are due quarterly, semi-annually, or yearly as set by the Board. Special assessments require 75% approval of owners present and voting. Late payments incur 18% annual interest plus a late fee of the greater of 15% of the delinquent amount or $100.
- Stormwater compliance: Each owner must construct stormwater facilities on their parcel in compliance with the Stormwater Permit. The association maintains common area improvements. Maximum built-upon area per parcel is allocated as shown on Exhibit B (e.g., Lot 1: 38,704 sq ft impervious out of 59,545 sq ft lot).
- Voting & governance: Each owner gets one vote per acre owned (plus fractional votes). Declarants (original developers) have Class B membership with 5 votes per acre until December 31, 2025, or earlier termination. During the Declarant Control Period, all Board decisions require unanimous approval.
- Fines & enforcement: The association may impose fines up to $100 per day for violations, after notice and a hearing. Fines become a lien on the parcel. The association or any owner may enforce restrictions through legal proceedings.
- Duration & amendment: The covenants run for 35 years from recording (2015), automatically renewing for three 10-year periods unless 85% of owners vote to terminate. Amendments require 51% of total votes and Declarant approval while they own any portion.
