What Seaside's governing documents say
This is a supplemental declaration of restrictive covenants for Seaside Phase 2B, a single-family home subdivision within the larger St. James Plantation master-planned community in Bolivia, NC. It applies to Lots 17-41 and adds rules on top of the master and Seaside declarations. The document binds all current and future owners of these lots.
- Land use & dwellings: Lots are for single-family residential use only. No business or commercial activity is allowed, except a temporary sales office or model with the developer's consent. No mobile, manufactured, or modular homes are permitted.
- Minimum home size: Each dwelling must have at least 1,280 heated square feet. Up to 200 of those square feet may come from covered porches that are part of the main roof line.
- Construction timeline: Construction must start within 90 days of closing and be completed within 6 months. The ACC may grant extensions for good cause. A dwelling cannot be occupied until the ACC issues a certificate of completion.
- Architectural review: All improvements, alterations, and landscaping must be approved in advance by the Architectural Control Committee (ACC). The ACC also decides the exact location of structures on each lot, considering views, privacy, and topography.
- Setbacks & easements: Minimum setback lines are shown on the plat. Easements for drainage, utilities, and pathways run 5 feet from front and side property lines, 5 or 10 feet from rear lines, and 15 feet from streets. Lakes and ponds have a 15-foot maintenance easement.
- Parking & vehicles: Boats, trailers, RVs, commercial vehicles, and trucks larger than half-ton may not be parked visible from the street for more than 24 hours (unless fully enclosed in a garage). Inoperative or unlicensed vehicles are similarly restricted. Off-road vehicles (go carts, dirt bikes, ATVs) are prohibited except for construction or golf course use.
- Pets & animals: No livestock or poultry. Dogs, cats, and other household pets are allowed if kept in compliance with laws and not for commercial purposes.
- Tree removal: No living tree 4 inches or more in caliper at 4 feet high, and no dogwood or flowering shrub, may be cut without ACC approval, except within the approved construction area.
