The Townhomes At Smithfield Iii At Brunswick Plantation is a townhome community in Bolivia, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, restrictions, easements, charges, and liens for the community, binding all owners and residents. It is part of a larger master-planned community (Brunswick Plantation) with a master association that imposes additional rules.
- What you own & maintain: You own your townhome lot and dwelling unit. The association maintains common elements (e.g., open spaces, lakes, recreational areas) and limited common elements (e.g., driveways, utility lines serving your unit). You are responsible for maintaining your lot and unit, including compliance with drainage and easement restrictions.
- Leasing & rentals: Leases must be for at least one year, and you cannot lease less than the entire dwelling. Timesharing or interval ownership is prohibited. All leases must be in writing, with a copy provided to the association within 10 days. The owner remains responsible for tenant compliance with all rules.
- Pets: Only usual household pets (dogs, cats) are allowed. Dogs must be leashed when outside the unit or limited common elements. Pets that are a nuisance or endanger health must be removed upon association request. No commercial breeding or kennels without approval.
- Parking & vehicles: No parking of boats, trailers, RVs, commercial vehicles, or oversized vehicles (over 19 feet, over 7,000 lbs, or more than 2 axles). No street parking except temporary (max 24 hours in a 2-day period). No parking on lawns. Vehicle repairs only in garages or for emergencies. Violators may be towed and fined.
- Architectural review: All exterior changes, including fences, landscaping, and structures, require approval from the Architectural Review Committee (ARC) or Board of Directors. No permanent structures in drainage or utility easements without approval. Fences must not impede drainage.
- Business & home occupations: No business activity that brings clients or generates significant traffic is allowed. Home offices are permitted if no clients visit and no business traffic is generated. No rooming houses, boarding houses, or trades.
- Assessments & fees: Owners pay regular assessments set by the Board and special assessments for capital improvements or operating deficits. A one-time capital contribution of $500 is due at initial sale. Assessments are a lien on the lot; unpaid assessments accrue 8% interest and may lead to foreclosure. The association may suspend voting and amenity use for nonpayment.
- Signs & displays: Political signs are allowed only 45 days before an election and must be removed within 7 days after; max one sign, 24x24 inches. 'For Sale' or 'For Rent' signs are allowed if they comply with association template and are no larger than 6 square feet. The association may regulate time, place, and manner of other displays.
