What Ascend Brunswick Forest's governing documents say
This is a stormwater management covenant for the Ascend at Brunswick Village development in Leland, NC, recorded by the developer D.R. Horton, Inc. It binds all lot owners and the homeowners association to maintain stormwater facilities and limit impervious surfaces per a Town of Leland permit.
- Stormwater & impervious surfaces: Each lot has a maximum built-upon area (BUA) in square feet, listed in Attachment A (e.g., 2200, 1700, 1300, 1020 sq ft). BUA includes structures, asphalt, concrete, gravel, brick, stone, slate, coquina, and parking areas, but excludes raised open wood decking and swimming pool water surfaces.
- Drainage & buffers: All runoff from built-upon areas must drain into the permitted stormwater system. A 50-foot vegetated buffer (30 feet for redevelopment) must be maintained between all impervious areas and surface water. Roof drains must terminate at least 50 feet from the mean high water mark of surface waters.
- Prohibited alterations: Filling in or piping of vegetative conveyances (ditches, swales) associated with the stormwater permit is prohibited, except for average driveway crossings. Alteration of drainage as shown on the approved plan requires Town of Leland concurrence.
- Association responsibilities & escrow: The homeowners association must continuously operate and maintain stormwater control facilities. An escrow account must be funded: developer pays 15% of initial construction cost of structural BMPs; annual sinking funds deposit two-thirds within 5 years and full amount within 10 years. The Town may use escrow for sediment removal, repair, or reconstruction.
- Town enforcement & lien: The Town of Leland has a right of entry to inspect and maintain BMPs, and may recover costs from the association. Failure to pay after 45 days' written notice constitutes a breach, and the Town may foreclose on a lien against the property.
