This is a partial, ancillary document — a set of restrictive covenants between a developer, a club, and a buyer, not a full community rulebook. It applies to two specific tracts of land (Adjacent Property Tract and Club Tract) in the Middle Island Plantation area of Bald Head Island, NC, and primarily benefits MIP 1, LLC. The document is poorly scanned and partially illegible.
- Building height restrictions: Structures on the Adjacent Property Tract cannot exceed 29.9 feet above mean sea level or two feet above the cabana building on the Club Tract, whichever is greater. The Club Tract has the same height limit. If MIP fails to exercise its purchase option, the height restriction on the Adjacent Property Tract becomes void, but the Club Tract restriction remains.
- Purchase option: If Young Realty wants to sell the Adjacent Property Tract, MIP 1, LLC has an option to purchase it under pre-agreed terms. This option does not apply if Young transfers the tract to a non-profit property owners' association or the Club for recreational use, but it would apply to any later transfer. The option expires 30 years from June 2007.
