Parkway Crossing at Brunswick Forest is a neighborhood of single-family homes within the larger Brunswick Forest master-planned community in Bolivia, NC. This document is the neighborhood's own declaration of covenants, conditions, and restrictions, which supplements the master declaration. It applies to all lot owners in Parkway Crossing and covers assessments, maintenance responsibilities, and architectural standards.
- What you own & maintain: You own your lot and the home on it. The association maintains the limited common areas (private streets, alleys, entrance features, mailbox kiosks) and provides lawn maintenance for the 'Lawn Elements' on your lot. You are responsible for all other maintenance of your lot and home, and must keep it consistent with community-wide standards.
- Assessments & fees: All lot owners pay Base Assessments (covering lawn maintenance, limited common area upkeep, utilities, insurance, and master association dues). A one-time Working Capital Assessment of $250 is due when you buy from the declarant. Special Assessments over $100 require a vote of half the members. The association can also levy Specific Assessments for violations or special services.
- Lawn maintenance: The association mows and maintains the 'Lawn Elements' (vegetation existing on your lot at the time of purchase from a builder) according to the Parkway Crossing Landscape Guidelines. This service is included in your Base Assessments. You cannot direct the schedule or scope; the board decides. The association may suspend or modify lawn service at its discretion.
- Architectural review: All lots are subject to architectural design standards adopted by the Master Association's Architectural Review Committee (ARC). You must get approval for any exterior changes. The neighborhood may also adopt its own Parkway Crossing Architectural Standards.
- Enforcement & fines: The association can fine you for violating the declaration, bylaws, or rules. If you fail to maintain your lot, the association may enter it, do the work, and charge you the cost plus a 15% service fee. Unpaid fines and charges become a lien on your lot and can be foreclosed like a mortgage.
- Master association obligations: As part of Brunswick Forest, you must also pay master association assessments, follow the master declaration and residential design standards, and comply with all master governing documents. The master association can veto actions taken by the Parkway Crossing association.
