What Osprey Landing at Brunswick Forest's governing documents say
Osprey Landing at Brunswick Forest is a single-family home neighborhood within the larger Brunswick Forest planned community in Bolivia, NC. This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners in Osprey Landing. It establishes the Osprey Landing Homeowners' Association, defines maintenance responsibilities, and sets rules for assessments, architectural standards, and use of common areas. Owners are also subject to the Master Declaration for Brunswick Forest, which includes additional fees and restrictions.
- Community type & structure: Osprey Landing is a 'Neighborhood' within the larger Brunswick Forest master-planned community. Lot owners are members of both the Osprey Landing Association and the Brunswick Forest Master Association, and must comply with both sets of governing documents.
- What you own & maintain: You own your lot and the home on it. The Association maintains the Limited Common Areas (private roads, sidewalks, entrance features, mailbox kiosks, common irrigation, retention structures) and provides routine landscape maintenance for all lots (e.g., mowing, trimming). You are responsible for maintaining your lot and home, including replacement of sod, trees, or plantings.
- Assessments & fees: All lots pay Base Assessments equally to fund maintenance, insurance, and operations. Special Assessments up to $100/year can be levied by the Board; larger amounts require majority owner vote. A one-time Working Capital Assessment of $250 is due at closing. Builders get a 240-day grace period from assessments on lots purchased from Declarant. Unpaid assessments accrue interest and can become a lien on the lot.
- Architectural review: All lots are subject to the Osprey Landing Architectural Standards adopted by the Master Association's Architectural Review Committee (ARC). Any exterior changes require ARC approval.
- Enforcement & fines: The Association can fine owners for violations, enter lots to remedy violations (charging the owner), suspend services and privileges (except access), and file liens for unpaid assessments. Owners also have the right to enforce covenants.
- Declarant rights & transition: Declarant (Funston Land & Timber) retains special rights during the Declarant Control Period (until Dec 31, 2043, or when it owns 5% or fewer lots). During this period, Declarant can amend the declaration unilaterally, annex additional property, and control the Board. After transition, owners gain full voting control.
- What this document doesn't cover: This document does not include specific rules about leasing, pets, parking, or age restrictions. Those may be addressed in the Master Declaration or other governing documents. It also does not specify the exact amount of Base Assessments or provide a full set of architectural standards.
