Meadow Park at Brunswick Forest is a neighborhood of detached single-family homes within the larger Brunswick Forest master-planned community in Bolivia, NC. This document is the neighborhood's own declaration of covenants, conditions, and restrictions (CC&Rs), which supplements the master declaration. It binds all homeowners, tenants, and occupants, and covers assessments, lawn maintenance, architectural standards, and rental rules.
- Master community & dual association structure: Meadow Park is a 'Neighborhood' within Brunswick Forest. All owners are members of both the Meadow Park Homeowners' Association and the Brunswick Forest Master Association. The master declaration and master governing documents also apply, and the Master Association can veto actions taken by the Meadow Park Association.
- Assessments & fees: Owners pay Base Assessments (covering lawn maintenance, limited common area upkeep, and master association dues), plus possible Special Assessments (up to $100 without owner vote), Specific Assessments, Insurance Assessments, a one-time Working Capital Assessment of $250 at purchase from Declarant, and a Transfer Fee of $250 upon resale (with exceptions). Assessments are a lien on the lot if unpaid.
- Lawn maintenance & landscaping: The Association provides lawn maintenance for all lots, with costs included in Base Assessments. Detailed care is governed by the Meadow Park Landscape Guidelines, which can be amended by 67% of lot owners after the Declarant Control Period.
- Leasing & rentals: Rentals for less than 12 months are generally prohibited. However, lots in the initial phase (Exhibit A) may be leased for shorter terms only through a rental program offered by the Declarant or its designee. Owners must notify the Master Association within 10 days of lease execution and provide tenants with governing documents.
- Architectural review: All lots are subject to architectural design standards adopted by the Master Association's Architectural Review Committee (ARC), in addition to any Meadow Park-specific standards.
- Easements & access: The Declarant and Association have easements for utilities, drainage, and maintenance, including a 4-foot non-municipal easement along side lot lines. They may enter lots for emergencies, inspections, and enforcement after notice (except in emergencies).
- Enforcement & fines: The Association may fine owners for violations, enter lots to remedy violations at owner expense, suspend services and privileges (except access), and foreclose on assessment liens. Fines and costs become part of the Base Assessment.
