What Ls Holden's governing documents say
This is a declaration of covenants, restrictions, and conditions for a single-family residential subdivision called L.S. Holden Subdivision, Block 6, in Holden Beach, North Carolina. It applies to all lot owners and future owners, and sets rules for what you can build, how you can use your property, and what the homeowners association may do.
- Architectural review: All new construction, exterior changes, fences, and landscaping must be approved in writing by the Declarant (or its designee) before starting. Plans are deemed approved if no response within 30 days. Approval can be denied for any reason, including aesthetics. Houses must be at least 1,400 sq ft of heated/cooled area (or max allowed by town if less), and must be Caribbean, Charleston, or Low Country style. Exterior must be completed within 7 months of starting construction.
- Land use & building type: Lots are for single-family residential use only. No business or commercial activity is allowed, except a temporary sales office with Declarant's consent. Only new construction is permitted; no moving homes from other properties, except one specific saltbox house that must be relocated to Lot 2 by January 1, 2020.
- Pets & animals: No livestock or poultry. Dogs, cats, or other household pets are allowed if not kept for commercial purposes and are always restrained. No stables, poultry houses, exterior dog pens, or similar structures.
- Parking & vehicles: Off-street parking for at least 2 cars must be provided before occupancy. Only personal passenger vehicles may be visible; buses, trailers, and campers are not visible except boat trailers parked under the heated area. Parking on Blockage Runner and Iron Age Drive is prohibited.
- Landscaping & maintenance: All yards must be landscaped within 120 days after town certification, with plans approved in writing. Failure results in a $50/day penalty and a lien. Owners must keep lots free of weeds, refuse, and unsightly conditions; Declarant may enter and clean after 10 days' notice and charge the owner.
- Property owners association: A mandatory homeowners association may be formed by 75% vote of lot owners. It can levy assessments for common area maintenance and enforce liens. Until Declarant sells its lots, association decisions on covenants and assessments are not binding on Declarant without its consent.
