What Irish Lane's governing documents say
Irish Lane (now Healy Haven Lane) is a single-family home subdivision in Bolivia, NC, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) recorded in 2022. These rules run with the land and bind all current and future lot owners.
- Land use & building type: Lots are for single-family residential use only. Each lot may have one detached single-family dwelling (max 2.5 stories), a garage for up to 6 cars, and incidental outbuildings. Minimum heated square footage is 2,400 sq ft (excluding porches, garages, etc.). Dwellings must be site-built.
- Architectural review: An Architectural Review Committee (at least 3 members appointed by the Association's Board) must approve all exterior construction, alterations, fences, walls, landscaping changes, and even repainting. Approval may be denied on purely aesthetic grounds. If the Committee does not act within 30 days of complete submission, the request is deemed approved.
- Setbacks & location: Dwellings must be at least 30 ft from the front property line, 15 ft from side lines, 30 ft from corner side lines, and 40 ft from the rear line. The Declarant may waive minor violations (up to 25%). On corner lots, dwellings may face the intersection.
- Exterior materials & colors: Exterior construction must use standard Hardie siding (or approved alternative). Foundations must be brick, stucco, concrete, or painted block. No material may be left unpainted or unpreserved; all colors require approval.
- Fences & walls: Fences require prior architectural approval. Chain-link and vinyl fencing are prohibited. No fence may be closer than 10 ft from a front corner of the dwelling or closer to a side street than the side building setback line.
- Parking & vehicles: Driveways and parking pads must be paved (concrete, asphalt, or masonry). Vehicles may only be parked on improved surfaces (garage, driveway, or parking pad). No campers, commercial vehicles, boats, or inoperative vehicles may be parked on streets or lots. Boats and recreational vehicles may be stored out of sight in a garage.
- Pets & animals: Only usual household pets are allowed; no livestock or commercial breeding. Pets must be leashed or fenced when outdoors. Owners must immediately remove pet waste. The Board may adopt rules for dangerous dogs or breeds, including prohibition.
- Maintenance & appearance: Each owner must keep their lot and improvements in neat, orderly condition and good repair. If a residence is destroyed, it must be repaired or reconstructed within 12 months. Construction must be completed with reasonable diligence. Dead trees posing a hazard may be removed.
