What Howells Point's governing documents say
This is a limited-purpose covenant agreement among a small group of property owners at Howells Point, Bolivia, NC, governing a single commonly-owned parcel (Lot 9) used for boat launching, parking, and shared access. It is not a full homeowners' association declaration; it binds only the current co-owners of that parcel and their heirs, not all residents of the area.
- What this document covers: The document creates shared rights and responsibilities for a specific parcel of land (Lot 9) used for boat launching, parking, and a pier/boat ramp. It does not govern individual homes or lots in the broader Howells Point area.
- Shared costs & maintenance: All parties share equally in property taxes, assessments, maintenance of the pier/boat ramp, insurance for shared uses, and costs to demolish an existing residential structure on the parcel.
- Use restrictions: No permanent structures may be built without unanimous written consent. No activity may obstruct the view of the creek/waterway from the Woodard lot (3854 Hickory View Drive SE, Bolivia, NC). No party may mortgage or encumber their interest without all parties' consent.
- Right of first refusal: Before selling their interest to an outsider, a party must first offer it in writing to the other co-owners. The other owners have 20 days to accept or reject. If they reject or don't respond, the seller may sell on those terms. Transfers to lineal descendants (children, grandchildren, including adopted) are exempt.
- Duration & enforcement: The covenants run with the land for 25 years from recording (January 2012), then auto-renew for 10-year periods unless all current owners agree to change them. Any party may enforce the restrictions.
- What this document doesn't cover: This document does not cover rules for individual homes, architectural standards, pet limits, leasing restrictions, or any other typical HOA regulations. It applies only to the shared parcel and its co-owners.
