Gardenwood at Brunswick Forest is a townhome community within the larger Brunswick Forest master-planned community in Bolivia, NC. This document is the neighborhood-level declaration of covenants, conditions, and restrictions that applies to all lot owners, residents, and their guests. It establishes the Gardenwood Homeowners Association, which provides exterior maintenance and lawn care, and requires compliance with both this declaration and the master association's governing documents.
- What you own & maintain: You own your lot and the townhome unit on it. The association maintains the exterior of each unit (roofs, siding, gutters, painting of exterior doors) and provides lawn maintenance for all lots. You are responsible for interior maintenance, windows, exterior doors (except painting), HVAC systems, and any damage caused by your negligence.
- Assessments & fees: All lot owners pay base assessments to cover lawn care, common area maintenance, and master association dues. A $500 working capital assessment is due at the initial purchase from the declarant. A $250 transfer fee is due from the purchaser upon resale (with some exceptions). Special assessments require approval of half of voting members. Late payments accrue interest and can lead to liens and foreclosure.
- Architectural review: All lots are subject to architectural design standards adopted by the master association's Architectural Review Committee (ARC). Any exterior changes must comply with these standards and the Gardenwood Architectural Standards.
- Party walls: Walls between attached townhome units are party walls. Repair costs are shared proportionally by the owners who use the wall. Each owner has an easement to enter an adjoining lot to perform party wall repairs.
- Insurance: The association carries property insurance on all buildings and improvements (replacement cost) and commercial general liability insurance (minimum $1 million per occurrence). Each owner must maintain personal liability insurance of at least $100,000 per occurrence and may insure personal property and improvements.
- Enforcement & fines: The association may fine owners for violations, enter a lot to remedy violations after 30 days' notice, and suspend services (except access) for unpaid assessments or other violations. Fines and repair costs can be added to the assessment and become a lien.
- Limited common areas: Certain areas (e.g., mailbox kiosks, entrance features, buffer easements) are designated as limited common areas for the exclusive use of Gardenwood owners. The association maintains these areas, and owners have easements to use them subject to association rules.
