What Beach Haven's governing documents say
Beach Haven is a single-family home subdivision in Bolivia, NC, governed by a homeowners association (HOA). This document is the full set of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners and occupants. It covers use restrictions, architectural standards, assessments, and HOA governance.
- Residential use & rentals: Lots are for single-family residential use only. Short-term rentals (less than 30 consecutive days) are prohibited, and no more than 3 rental agreements per 12-month calendar year are allowed. Home-based businesses are allowed only with Board approval and must not disrupt the residential character.
- Occupancy limits: Each dwelling unit may have no more than 2 persons per bedroom, unless otherwise approved by the Board.
- Parking & vehicles: Permitted vehicles include standard passenger vehicles in good repair. Commercial vehicles, RVs, boats, trailers, campers, and oversized vehicles are not allowed to park in the community unless authorized, and may not be parked outside a storage area or garage for more than 2 days. Golf carts are allowed with registration, insurance, and equipment requirements; operators must be at least 16.
- Pets: Only common household pets (dogs, cats, birds, fish) are allowed. No more than 3 dogs per household. Dogs must be leashed in common areas and not left unattended outside. Owners must clean up waste. Service animals are not subject to breed restrictions or pet fees.
- Architectural review: An Architectural Review Committee (ARC) must approve all exterior modifications, including fences, outbuildings, swimming pools, landscaping changes, and tree removal. Fences may not exceed 4 feet in height and must be in rear or side yards. Above-ground pools are prohibited; in-ground pools require ARC approval. No window-mounted AC units are allowed.
- Signs & flags: Signs require prior approval, except for one real estate sign, political signs (allowed 45 days before an election, removed 7 days after, max 24x24 inches), and temporary event signs (max 24x36 inches, one per lot, displayed 48 hours before to 24 hours after event). Flags permitted include U.S., state, military, and NCAA sports team flags; permanent flagpoles are not allowed.
- Assessments & fees: Annual assessments are set by the Board and apportioned equally per lot. Special and capital assessments may also be levied. A transfer assessment is due upon resale (amount set by Board). Unpaid assessments accrue interest and become a lien on the property, enforceable by foreclosure.
- Prohibited activities & nuisances: Fireworks, firearms discharge, and archery are prohibited. No noxious or offensive activities, unsightly conditions, or obstruction of drainage. Tree removal of trees 4 inches or more in diameter requires ARC approval. Corner lots must maintain clear sight lines.
