Westview at River Oaks is a single-family home HOA in Wilmington, NC. This declaration of covenants, conditions, and restrictions (CC&Rs) binds all lot owners and sets rules for the community. It covers architectural standards, use restrictions, assessments, and association governance.
- What you own & maintain: You own your lot and the dwelling on it. The association maintains common areas (private roads, sidewalks, open space). You must keep your lot free of weeds, underbrush, and refuse; the association may enter and clean up at your expense after 30 days' notice.
- Architectural review: All exterior improvements or modifications require prior approval from the Architectural Control Committee (appointed by the developer during the Declarant Control Period, then by the association). The committee may consider aesthetics and harmony with surroundings. Approval expires if construction doesn't start within 6 months or finish within 1 year.
- Leasing & rentals: Rental contracts for residences must be for a term of at least three consecutive months. No short-term or vacation rentals are allowed.
- Parking & vehicles: Only standard passenger vehicles, passenger vans, and pick-up trucks may be parked in the community. Boats, watercraft, recreational vehicles, and inoperable vehicles are prohibited on lots, streets, or common areas. Vehicle repairs are only allowed in garages.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. Pets must be leashed and under control at all times, and owners must immediately clean up waste. No livestock or poultry are permitted.
- Assessments & fees: All lot owners (except the developer) must pay annual assessments, plus possible special assessments for capital improvements, insurance, ad valorem taxes, and a working capital assessment equal to two months' assessments at closing. Unpaid assessments become a lien on the lot and accrue interest at the highest legal rate.
- Use restrictions: Lots are for single-family residential use only. No temporary structures, trailers, or outbuildings as residences. No noxious activities, nuisances, or unsightly conditions. Signs, satellite dishes over 18 inches, and yard statuary are restricted. Christmas decorations only between Nov 20 and Jan 7.
