Creekstone Subdivision is a single-family home community in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1976. These covenants run with the land and bind all current and future lot owners, ensuring the neighborhood remains attractive and residential.
- Residential use only: All lots are for single-family residential purposes only. No noxious or offensive trades, activities, or nuisances are allowed.
- Minimum home size & exterior materials: Each residence must be at least 1,000 square feet (exclusive of porches, garages, etc.). Exteriors must be conventional frame or clay brick; concrete brick, asbestos siding, cinder block, and composition tar paper are prohibited.
- Setbacks & building lines: No building may be closer than 25 feet to the front property line, nor nearer than 10% of the lot's front width to any side boundary. The developer may adjust setbacks by up to 10% with adjacent owners' consent.
- Temporary structures & vehicles: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences. No inoperative junk cars or eyesores may be maintained on the property.
- Signs: Only private name plates, identification signs, and 'For Rent' or 'For Sale' signs are allowed. No other signs or billboards are permitted.
- Fences: Fences may not exceed 4 feet in height and must be located no closer to the front lot line than the rear corners of the house.
- Animals: No domesticated farm animals or fowls may be kept on the property.
- Duration & amendment: These restrictions run for 20 years from July 23, 1976, and automatically renew for successive 10-year periods unless a majority of lot owners (not under legal disability) vote to revoke or amend them.
