The declaration governs unit owner rights and obligations, including assessments, use restrictions, and insurance.
- What you own & maintain: You own the interior finished surfaces of your unit (walls, floors, ceilings) and interior partitions. The association owns and maintains the common elements, including perimeter walls, pipes, wires, stairwells, entranceways, and parking areas. Balconies, decks, or patios are reserved for the exclusive use of the adjacent unit.
- Assessments & liens: The association can levy assessments for common expenses. Unpaid assessments become a lien on your unit, securing the amount due plus interest and attorney's fees. The association may also pay delinquent property taxes and specially assess the owner.
- Occupancy & use: Units may be used only as private dwellings. You cannot do anything that increases insurance rates, obstructs other owners, or creates a nuisance (e.g., unreasonable noise or odors).
