Hillside Subdivision is a single-family residential community in Wilmington, NC, governed by a declaration of covenants, conditions, and restrictions (CC&Rs) recorded in 1970. These rules apply to all lot owners and are designed to maintain the area for attractive residential use.
- Property use & building type: All lots are for single-family residential use only. Only one detached single-family dwelling (max 2.5 stories), a private garage for up to 3 cars, and incidental outbuildings (including servant's quarters) are allowed.
- Setbacks & minimum size: Buildings must be at least 30 feet from the front property line, 10 feet from side boundaries, and 20 feet from side street lines. On corner lots, the side with less frontage is considered the front. Each residence must have at least 800 square feet of heated floor space.
- Temporary structures & trailers: No house trailers, tents, shacks, or temporary structures may be used as a residence, either temporarily or permanently.
- Architectural review: Plans for all dwellings and incidental structures must be submitted to the Developer or its Agent for written approval within 10 days; failure to respond within 10 days constitutes automatic approval.
- Nuisances & maintenance: No noxious or offensive trade or activity is allowed. Domestic farm animals or fowls are prohibited. Yards must be properly maintained; unsightly inoperative junk cars and similar eyesores are not permitted.
- Signs: No signboards are allowed on residential lots except 'For Rent' or 'For Sale' signs, which may not exceed 2 feet by 3 feet.
- Fences: No fence or obstruction may extend nearer the street than the front setback line of the main dwelling, and no fence may exceed 4 feet in height.
- Duration & amendment: These covenants run with the land and were originally effective until November 1, 1999, with automatic 10-year extensions unless 60% of lot owners vote to change them.
