Round Tree Ridge is a single-family home HOA in Wilmington, NC. You own your lot and house; the association maintains common areas like stormwater ponds, wetlands, and private streets. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land.
- Architectural review: All exterior construction, additions, or changes must be approved in writing by the Declarant or an Architectural Review Committee. Plans are deemed approved if no response within 30 days. Minimum house size: 1,200 sq ft (one story) or 1,800 sq ft (two story); maximum: 3,500 sq ft (one story) or 4,000 sq ft (two story). No concrete block, asbestos, or aluminum siding allowed.
- Use restrictions: Lots are for single-family residential use only. No noxious or offensive activities. No trailers, tents, or temporary structures as residences. Recreational vehicles must be parked in the back yard and screened from street view. No inoperable or unregistered vehicles; tractor-trailers prohibited. Signs require permission except for Declarant's sales signs.
- Pets & animals: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed and not allowed to run free. No livestock or poultry.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars, constructed of concrete, brick, asphalt, or turfstone. No overnight on-street parking. Boats, campers, motor homes must be parked in the back yard and screened.
- Assessments & fees: Annual assessments and special assessments (approved by 2/3 vote) fund maintenance of private streets, stormwater facilities, wetlands, and common areas. Assessments are a lien on the property and personal obligation of the owner. Unpaid assessments bear 18% annual interest. The association can foreclose or sue.
- Lot maintenance & landscaping: Owners must keep lots free of weeds, underbrush, and unsightly growth. Front, rear, and side yards must be sodded except for planting beds. The association may enter and clean after 30 days' notice, charging the owner. Trees over 10 inches in diameter at base cannot be cut without committee approval.
- Stormwater & environmental restrictions: Maximum built-upon area per lot is 4,000 sq ft. No filling or piping of ditches or swales except driveway culverts. A 30-foot vegetated buffer must be maintained between impervious areas and surface waters. Roof drains must terminate at least 30 feet from surface waters. These covenants cannot be changed without state approval.
- Amendment & duration: The covenants run for 20 years from recording (2017), then auto-renew for 10-year periods. Amendments require 90% owner approval during the first 20 years, then 75% thereafter. Any amendment must be recorded.
