What Weatherwood at Summerfield's governing documents say
Weatherwood at Summerfield is a single-family home subdivision in Wilmington, NC. These restrictions apply only to Section II and are enforced by the developer (Landmark Organization, Inc.) until a homeowners association is formed. They run with the land for 20 years (through 2009) with automatic 10-year extensions unless a majority of lot owners votes to revoke or amend.
- Residential use only: All lots are for single-family residential purposes only. No house trailer, mobile home, tent, shack, or temporary structure may be used as a residence.
- Minimum house size: Each residence must have at least 1,000 square feet of heated floor space (excluding porches, garages, etc.). The developer may approve a dwelling up to 10% smaller if it fits the subdivision's character.
- Exterior materials & colors: Exteriors must be conventional frame, wood, masonite-type hardboard, vinyl, brick, clay brick, or stucco. Concrete block, asbestos siding, aluminum siding, and tar paper are prohibited. Paint colors at closing cannot be changed for five years without developer approval.
- Roof requirements: Roofs must have a minimum pitch of 6/12 unless the developer grants a variance. Roofing colors must be earth tones (browns, blacks, grays).
- Setbacks & site approval: No specific setback lines are set; the developer controls and must approve all house locations and plot plans. Minimum distances from front and side lot lines are set by New Hanover County ordinances. On corner lots, the side with the least frontage is considered the front.
- Fences & hedges: Fences and hedges require written developer approval. Fences facing or parallel to the street must be wood. No fence or hedge is allowed nearer the front lot line than the rear corners of the house unless approved. Corner lots must have a fenced rear area at least 20x20 feet for storing lawnmowers, bicycles, toys, grills, etc.
- Vehicles & storage: Boats must be kept inside a storage building or in the back yard, not visible from the street. No satellite dishes or exterior antennas without written approval. No inoperative, unlicensed, or junk cars may be maintained on any lot.
- Yard sales & nuisances: No yard sales or garage sales are permitted. No noxious or offensive activity is allowed. Domestic farm animals or fowls may not be raised, bred, or kept.
