Amsterdam Park is a standard single-family home HOA in Wilmington, NC. This document is the full Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all owners, tenants, and occupants of building sites within the subdivision.
- What you own & maintain: You own your building site and any improvements on it. The Association maintains the Common Areas (e.g., roadways, walkways, plantings, lighting) and pays for their operation and liability insurance. You are responsible for all maintenance of your own building and improvements, including interior and exterior, except what the Association specifically handles.
- Membership & voting: Every owner of a building site is automatically a member of the Amsterdam Park Association. Each building site gets one vote, regardless of how many people own it. The Declarant (developer) controls the Board until 75% of sites are sold or December 31, 1997, whichever comes first.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 5% per year without a membership vote; larger increases require a 2/3 vote. Special assessments for capital improvements also need 2/3 approval. A working capital assessment equal to two months' estimated dues is due at closing. Assessments are a lien on the property and a personal obligation of the owner when due.
- Architectural review: No building, structure, exterior alteration (including painting), or sign may be built or changed without prior written approval of the Declarant (or later the Board or an architectural committee). Approval may be denied for any reason, including aesthetics. If no decision is made within 30 days of submission, approval is deemed given.
- Use restrictions: No auto repair, paint, or sales shops without approval. No noxious or offensive activities, hazardous materials, or antennas without permission. No inoperable vehicles, vehicles without current registration/insurance, or tractor-trailers may be kept on the premises; the Association may tow them at owner expense. Building sites cannot be subdivided without consent.
- Leasing & rentals: The document does not impose any minimum lease term or restrict leasing. However, all tenants and occupants must comply with the Declaration.
- Pets: The document does not contain specific pet restrictions, but it prohibits maintaining any plants or animals whose normal activities may diminish others' enjoyment of property.
