What Wyck Farm's governing documents say
Wyck Farm is a single-family home HOA in Wilmington, NC. The rules apply to lot owners and are enforced by the Wyck Farm Homeowners' Association. This document sets out the covenants, conditions, and restrictions that govern the community.
- What you own & maintain: You own your lot and the dwelling on it. The association maintains common areas (including private roads) and limited common areas (if any). You must keep your lot free of weeds, underbrush, and unsightly conditions; the association may enter and clean up at your expense after 30 days' notice.
- Architectural review: All exterior construction, additions, alterations (including painting) require prior written approval from the Declarant, the Board, or an Architectural Control Committee. Approval may be based on purely aesthetic grounds. If no decision is made within 30 days, approval is deemed given.
- Building & lot standards: Only single-family dwellings are allowed, with a minimum of 1,300 sq ft of enclosed heated area (1,250 sq ft may be permitted by the Committee). Dwellings cannot exceed two stories without approval. No structure can be closer than 10 feet to an adjoining property line. Exterior construction must be completed within 12 months. No more than 3,585 sq ft of any lot may be covered by structures or paved surfaces.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars, built of concrete, brick, asphalt, or turf stone. Boats, campers, trailers, motor homes, inoperable vehicles, and vehicles without current registration are not allowed on lots or streets without written consent. Vehicle repairs must be done in garages or areas not visible from the street.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed or under control at all times and must not become a nuisance.
- Leasing & rentals: The document does not address leasing or rental restrictions.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 5% per year without a member vote; increases above 5% require a 2/3 vote. The Board may set the initial annual assessment at up to $60 per lot. Special assessments for capital improvements require 2/3 member approval. A one-time working capital assessment of $50 is due at closing. Assessments are a lien on the lot and a personal obligation of the owner.
- Signs & exterior appearance: No signs are allowed without Board permission, except a single 'for sale' sign conforming to local ordinances. Window coverings visible from outside must be white or neutral. Exterior light bulbs must be clear, white, or non-frost. No yard statuary, TV satellite dishes, or outside antennas are allowed without permission. Clotheslines are not permitted.
