What The Pointe's governing documents say
The Pointe is a residential homeowners' association (HOA) in Montgomery County, Texas. This document is a Second Amendment to the Declaration of Covenants, Conditions and Restrictions, updating rules on insurance, late fees, architectural deposits, short-term rentals, construction debris, contractor parking, noise, and variance procedures. It binds all lot owners in the subdivision.
- Leasing & rentals: Short-term rentals are prohibited. All leases must be for a minimum term of one year, except for temporary leasebacks during a bona fide sale of the lot.
- Architectural review: A non-refundable deposit is required for major exterior improvements (excluding pools/docks). A refundable deposit is required for construction lasting more than two months. A fine is assessed if construction exceeds one year.
- Insurance requirements: Each owner must maintain fire and extended coverage insurance on their residence equal to replacement cost. If an owner fails to repair or rebuild after damage, the association may do so and assess the cost as a lien.
- Late fees: If an assessment is not paid by the due date, the association may charge a late fee of 10% of the delinquent amount, in addition to interest and collection costs.
- Construction & debris: Portable toilets are prohibited. Only small, wheeled construction-debris containers that fit entirely in the driveway are allowed; full containers must be removed by end of day. No large roll-off containers or debris piles are permitted.
- Contractor parking: For renovations lasting more than one week, contractor parking is not allowed inside the subdivision gates except during loading/unloading or in the owner's driveway. Contractor vehicles must park on the public street adjacent to the reserve area.
- Noise: Music must not be audible from outside the perimeter of the home on a lot.
- Variances: The Architectural Review Committee or Board may grant variances only in cases of extreme hardship from extraordinary events (e.g., natural disasters). The variance must be the minimum necessary, not detrimental to surrounding lots, and not alter community character. Variances do not set precedent.
