Saponos Pointe is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). These covenants apply to all lot owners and set rules for construction, design, and use of property to maintain a uniform, harmonious neighborhood.
- Architectural review: All buildings, fences, walls, and site alterations require prior written approval from the Architectural Review Committee (ARC). The ARC has sole discretion over design, materials, colors, and location, and can deny plans for any reason including aesthetic considerations. Plans not ruled on within 30 days are deemed approved.
- Building size & design: Only single-family dwellings are allowed. Minimum heated floor area: 2,000 sq ft for one-story, 2,400 sq ft for two-story, 2,800 sq ft for three-story homes. Approved exterior materials include brick, stucco, stone, natural wood, and vinyl. Roof materials must be wood shakes/shingles, asphalt shingles (300 lb+), slate, or standing seam metal. Flat roofs are not allowed.
- Setbacks & grading: No fixed setback lines; the ARC controls the location of all structures. Extensive lot grading is prohibited without ARC approval. Drainage must direct runoff to streets or natural channels, not onto adjacent lots.
- Driveways & parking: Each lot must have a garage for at least two cars and accommodate two additional off-street parking spaces. Driveway materials must be black/dark gray concrete, brick, asphalt, exposed aggregate, or ARC-approved. Front-loading garages require offset driveways to screen the garage door.
- Fences & walls: Perimeter fencing is discouraged. Fences and walls must match the home's exterior materials and color. Split rail, chain link, and welded wire fencing are not allowed. Pet pens and dog runs must be screened from streets and neighbors.
- Landscaping & tree protection: Landscape plans must integrate the house with natural lot features. No tree larger than 10 inches in diameter may be removed without ARC approval. During construction, protective fencing is required around trees to be preserved.
- Pets: Only dogs, cats, and household pets are allowed; no horses, cattle, swine, poultry, or livestock. Pets cannot be kept for commercial purposes.
- Leasing & rentals: The document does not address minimum lease terms or restrictions on renting. Leasing is not prohibited, but all other covenants (e.g., architectural review, maintenance) apply to tenants as well.
