What Apple Valley Subdivision's governing documents say
Apple Valley Subdivision is a standard single-family home HOA in Wilmington, NC, covering only Section 3. These restrictive covenants run with the land and bind all current and future lot owners.
- Land use & building type: Lots are for residential use only. Only one detached single-family dwelling (max 2 stories) and a private garage (max 1 story, no living quarters) are allowed. No garage apartments, temporary structures, trailers, mobile homes, tents, or barns.
- Minimum home size: Dwellings must have at least 850 square feet of heated living area, measured from exterior walls, excluding porches, garages, and carports.
- Setbacks & building location: Buildings must be at least 25 feet from the front road right-of-way and 8 feet from side lot lines (or per county zoning). Eave overhangs up to 3 feet and uncovered stoops/steps are allowed within setbacks. Combined lots for one residence treat interior boundaries as not side lines.
- Architectural review: Plans for all dwellings and structures must be approved by Apple Valley, Inc. or its successor. If no response within 20 days of submission, plans are deemed approved if in general conformity with other structures.
- Pets & livestock: No livestock (hogs, cattle, sheep, goats, horses, poultry) allowed. Maximum one dog per lot, and the dog must weigh 50 pounds or less.
- Fences & signs: Fences or obstructions cannot exceed 4 feet in height in front of the house's front corners. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 5 square feet.
- Stormwater & environmental restrictions: Each lot has a maximum allowable built-upon area (impervious surface) listed in Exhibit A. A 30-foot vegetated buffer must be maintained between impervious areas and surface waters. Filling or piping of vegetative conveyances is prohibited except for average driveway crossings. These restrictions can only be changed with state consent.
- Duration & amendment: Restrictions (except #6) remain in effect until December 31, 2030, then auto-renew for 10-year periods. They can be amended by written document signed by the developer and owners of at least 60% of lots. Termination requires 75% of lot owners. Restriction #6 (stormwater) can only be modified with state consent.
