Gala Acres at Apple Valley is a standard single-family home subdivision in Wilmington, NC. These restrictive covenants run with the land and bind all current and future lot owners. They cover what you can build, how you can use your property, and basic maintenance standards.
- Residential use only: Lots may only be used for residential purposes. No commercial, noxious, or nuisance activities are allowed. Unsightly junk cars and improperly maintained yards can be cleaned up by the developer at the owner's expense.
- Building & size requirements: Only one detached single-family dwelling (max 2 stories) plus a private garage (max 1 story, no living quarters) per lot. Minimum heated living area is 850 square feet (excluding porches, garages, carports). Plans must be approved by Apple Valley, Inc. (or deemed approved after 20 days if no response).
- Setbacks & stormwater limits: Buildings must be at least 30 feet from the front road right-of-way and 8 feet from side lot lines (or per county zoning). Maximum built-upon area per lot is 4,800 square feet (including structures, pavement, gravel, etc., but not raised wood decking or pool water surface). A 30-foot vegetated buffer must be maintained between impervious areas and surface waters.
- Pets & animals: No livestock or poultry. Dogs, cats, or other household pets are allowed but not for commercial purposes; they must be leashed or controlled and not become a nuisance.
- Fences & signs: Fences or obstructions over 4 feet high cannot extend nearer the street than the front corners of the house. Signs are limited to 'For Sale' or 'For Rent' signs no larger than 5 square feet.
- Temporary structures & satellite dishes: No trailers, mobile homes, tents, shacks, barns, or other outbuildings are allowed. Satellite dishes are prohibited.
- Duration & amendments: These restrictions (except stormwater rule #6) remain in effect until December 31, 2030, then auto-renew for 10-year periods unless terminated by 75% of lot owners. Amendments require written consent of the developer and 60% of lot owners. Stormwater restrictions can only be changed with state approval.
