Governor's Landing is a planned community of townhomes in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants and restrictions that applies to all lot owners, residents, and their guests.
- What you own & maintain: You own your lot and the townhome on it. The association maintains all common elements (e.g., private roads, stormwater facilities, open space) and limited common elements (exterior of dwellings, roofs, decks, gutters, and boat slips assigned to your lot).
- Boat slips & community boating facility: The community has a boating facility with ten boat slips. Nine are assigned for exclusive use of individual lot owners; one is reserved for common use by all owners under association rules.
- Assessments & fees: Each lot owner must pay annual assessments, special assessments (approved by 2/3 vote), insurance assessments, ad valorem tax assessments, and a one-time $200 working capital assessment upon purchase from the developer. Assessments are a lien on the lot and a personal obligation of the owner when due.
- Developer rights & transition: The developer retains special rights (e.g., control of architectural review, ability to annex additional property, amend declaration without member vote) until the declarant control period ends (December 31, 2007 or earlier surrender). After that, control passes to lot owners.
- Architectural control: All exterior changes to lots and townhomes are subject to approval by an Architectural Control Committee, which is controlled by the developer during the declarant control period.
- Insurance: The association must maintain property and liability insurance on common elements (minimum $1,000,000 liability, 80% replacement cost). Each lot owner is an insured under the master policy. Owners may vote (67% approval) to switch to individual policies.
- Easements & access: The association and developer have easements over lots for utility installation, maintenance, and emergency access. Owners must not obstruct these easements.
