Twin Wood of Wilmington is a townhome community in Wilmington, NC, governed by a declaration of restrictions that runs with the land. Each lot is part of a two-unit townhouse, and owners are responsible for exterior maintenance of their own lots. The rules cover land use, building size and location, party walls, architectural control, and other typical subdivision restrictions.
- Land use & building type: Lots may only be used for residential purposes. Each lot can have one half of a two-unit townhouse (max 2.5 stories), a private garage (which may include servant quarters), and appurtenant outbuildings matching the dwelling's design. Single-family detached homes are allowed as model homes for sales.
- Dwelling size & quality: Minimum ground floor area (excl. open porches and garages): 750 sq ft for a one-story single-family home, 700 sq ft for a multi-story single-family home, or 1,200 sq ft of enclosed heated area for a duplex. Plans must meet FHA minimum property standards.
- Building location & setbacks: Corner lots: front setback at least 15 ft, side street setback at least 20 ft. Interior lots: front setback at least 15 ft, side setback at least 10% of average lot width, rear setback at least 25 ft. Accessory buildings must be at least 10 ft from rear lot line. A 10% error in location is not a violation.
- Exterior maintenance: Each lot owner must maintain the exterior of their lot, including roofs, gutters, downspouts, exterior surfaces, trees, grass, walks, and other improvements.
- Party walls: Walls built on the dividing line between lots are party walls. Repair and maintenance costs are shared in proportion to use. If destroyed by fire or casualty, any owner who used the wall may restore it, and others who later use it must contribute. Negligent acts causing exposure to elements are the sole cost of the responsible owner. Disputes go to arbitration.
- Architectural control: No building, fence, wall, or other structure may be erected or altered without written approval from a 3-member architectural committee chosen by lot owners. Plans must show design, materials, and location. If the committee fails to act within 30 days, approval is deemed given. Outside antennas and exterior light bulbs (must be clear/white) are also regulated.
- Pets & livestock: No livestock or poultry may be raised or kept. Dogs, cats, or other household pets are allowed but not for commercial purposes.
- Fences & signs: Fences between the front building line and street: max 3 ft. Fences between the front building line and rear lot line: max 6 ft. Corner lots with adjacent lots sharing a right-of-way: max 3 ft along the right-of-way. Signs: one professional sign (max 1 sq ft, parallel to building), one sale/rent sign (max 3 sq ft), or builder signs during construction.
