The Cottages at Sun Coast is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners and residents, establishing rules for residential use, property maintenance, and community standards.
- Lot use & residential-only: Lots may be used only for residential purposes. No business, commercial, or professional activities are allowed. Mobile homes, modular homes, and other manufactured housing are prohibited. The developer may build multi-family units (apartments, condos) on replatted lots.
- Architectural & design control: All building designs, construction materials, and exterior colors must be approved in writing by the developer (or later the association). Exterior changes require approval. White window coverings visible from outside are required within 10 days of occupancy; bedsheets, towels, etc. are not allowed. Exterior antennas and satellite dishes (except small dishes under 18 inches) are prohibited without permission.
- Maintenance & landscaping: Lot owners must keep their property neat and tidy. The association maintains front, side, and backyard areas outside fenced enclosures, including irrigation systems. Owners maintain fenced areas and must pressure-wash exteriors annually (cost covered by association dues). No landscaping other than that provided by developer/association is allowed outside fenced areas.
- Parking & vehicles: Vehicles must be parked in driveways only; no parking on lawns, roadways, or common areas. Maximum three vehicles per residence without written approval. Inoperable vehicles, those without current registration/inspection/license/insurance, and tractor-trailers are prohibited. No vehicle repairs in driveways lasting more than one day. Boats, RVs, campers, and trailers must be parked in the backyard out of street view.
- Pets: No livestock or poultry. Up to four household pets (dogs, cats) allowed per lot. Pets must be confined within a fenced area or on a leash when outside. Owners must clean up pet waste; costs for removal by the association may be charged as a special assessment.
- Fencing & structures: The developer installs initial fencing around each lot; the association maintains those fences. No other fencing is allowed without written approval. Temporary structures (trailers, tents, sheds) are prohibited unless approved. No clotheslines or fuel tanks visible from public view.
- Assessments & fees: All lot owners (except developer) must pay annual assessments and a nonrefundable working capital assessment equal to three months of the annual assessment at purchase. Assessments may increase up to 10% per year without member vote; larger increases require 2/3 vote. Special assessments for capital improvements also require 2/3 vote. Unpaid assessments accrue interest and become a lien on the lot.
- Leasing & rentals: The document does not restrict leasing or rentals. For-sale and for-rent signs are prohibited until the developer sells the last lot.
