Stonington Subdivision is a single-family home HOA in Wilmington, NC. These covenants run with the land and bind all current and future lot owners. The document establishes a homeowners' association with assessment powers and sets rules for construction, use, and maintenance of lots.
- Residential use only: All lots must be used solely for single-family residential purposes. No house trailers, mobile homes, tents, shacks, or temporary structures are allowed as residences.
- Architectural review: No building, fence, or other structure may be erected or altered without written approval of the Developer (or its successors). Approval may be based on any grounds, including aesthetics, in the Developer's sole discretion. Plans are deemed approved if not disapproved within two weeks of submission.
- Minimum house size: Each residence must have at least 1,500 square feet of heated floor space, excluding porches, garages, and other non-living areas. The Developer may approve a dwelling up to 5% smaller at its discretion.
- Exterior materials: Exteriors must be conventional frame, brick, clay brick, or stucco. Concrete block, concrete brick, asbestos siding, aluminum siding, vinyl siding, cinderblock, and tarpaper composition are prohibited. Vinyl or aluminum soffits are allowed.
- Trees and landscaping: No clear-cutting of trees is allowed. Trees to be cut must be marked on plans submitted for approval. Trees with a diameter less than 1 inch (or circumference less than 3.25 inches) measured 12 inches above ground are exempt. Lots must be kept mowed and free of unsightly objects.
- Parking & vehicles: No trucks over 3/4 ton, trailers, tractors, motor homes, campers, or vehicles producing excessive noise or wear are permitted on lots or streets. Inoperative junk cars, boats, and trailers are prohibited.
- Assessments & HOA: A homeowners' association is established. Annual assessments start at $60 per lot, payable semi-annually, and may increase up to 5% per year without a membership vote. Special assessments require a 2/3 vote. Assessments are a lien on the lot and a personal obligation of the owner.
- Construction timeline: Construction must commence within 12 months of closing and be completed within 12 months of commencement. The Developer has a buy-back option if the owner fails to start construction within 12 months, exercisable within 24 months of the original sale.
