What Spring View's governing documents say
Spring View is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1969. These covenants run with the land and apply to all lots in Section 4, binding current and future owners.
- Residential use & building type: Lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage is allowed per lot.
- Setbacks & lot size: Buildings must be at least 60 feet from the front lot line and 10 feet from side lot lines. Lots cannot be re-subdivided unless each part merges with another whole lot.
- Minimum square footage: Each dwelling must have at least 1,200 square feet of interior living space, excluding garages and porches.
- Architectural review: Plans and specifications for all buildings must be approved by the Developer (or its Attorney-in-fact).
- Exterior materials & design harmony: Exterior materials are limited to wood, brick, brick veneer, concrete block with stucco, tile with stucco, or concrete with stucco. Architectural designs must be in harmony with existing structures.
- Sewage disposal: Until municipal sewer is available, septic tanks approved by the NC State Board of Health are required. Once municipal sewer becomes available, no new septic tanks may be installed and all sewage must connect to the municipal system.
- Duration & amendment: These covenants run with the land until February 1, 1994, and automatically renew for successive 10-year periods unless a majority of owners votes to change them.
- Enforcement: Any owner in the subdivision may sue to enforce these covenants or recover damages for violations.
