What Crestwood's governing documents say
Crestwood is a single-family home subdivision in Wilmington, NC, governed by a 1966 Declaration of Restrictions that runs with the land. These rules apply to lot owners in Section Four and cover residential use, building size and materials, setbacks, and architectural approval.
- Residential use & structures: Lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories) plus a 1- or 2-car garage is allowed. No trailers, tents, or outbuildings may be used as residences.
- Minimum house size & materials: Dwellings must have at least 1,100 square feet of interior living space (excluding garage). Exterior must be stone, brick, or brick veneer; garages must match the dwelling's materials.
- Setbacks & lot lines: Buildings must be at least 50 feet from the front street line and 10 feet from any side property line. For corner lots, the side with less street frontage is considered the front.
- Architectural review: Building design and plan must be approved by the developer (F-G-S, Inc. or its agent). Approval or denial must come within 10 days of written request; if no response, approval is not required. The design must harmonize with existing structures.
- Lot subdivision: No lot may be re-subdivided unless the split part becomes part of an adjacent whole lot and the remainder also becomes part of another whole lot.
- Nuisance & offensive activity: No obnoxious or offensive activity is allowed on any lot, nor anything that may become an annoyance or nuisance to the neighborhood.
- Sewage disposal: Until municipal sewage is available, sewage must be disposed of by septic tank approved by the North Carolina State Board of Health.
- Duration & amendment: These restrictions run with the land until June 1, 1984, after which they may be waived or released by consent of a majority of lot owners.
