Saybrook at Landfall is a single-family home HOA in Wilmington, NC. You own your lot and detached home; the association maintains common areas and contracts for landscaping of all lots (except watering and irrigation on your lot). The community is part of a larger master association (Landfall Council of Associations) that also imposes assessments and rules.
- What you own & maintain: You own your lot and detached home (minimum 2,000 sq ft exclusive of porches, decks, garages). You must maintain your dwelling and the irrigation system within your lot. The association contracts for landscaping and landscape maintenance of all lots, but you are responsible for watering vegetation and maintaining the irrigation system on your lot.
- Assessments & fees: Annual assessments are levied per lot. The maximum annual assessment was $720 per lot until January 31, 2002; after that, the board can increase it up to 20% per year without a member vote. Increases over 20% require a 2/3 vote of each membership class. Special assessments for capital improvements also require a 2/3 vote. Delinquent assessments bear 12% interest and may result in a lien or personal action.
- Leasing & rentals: No home may be leased for less than six months, and you cannot lease less than the entire unit. Leases must be in writing and subject to the declaration and bylaws. Transient or hotel purposes are prohibited.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be kept in the home or in an area approved by the Architectural Control Committee of the Landfall Council of Associations.
- Parking & vehicles: Each owner must provide off-street parking. No trucks, boats, trailers, or commercial vehicles may be stored, housed, or parked on the property except within an enclosed garage. Parking on streets or common areas is prohibited.
- Use restrictions: Lots and homes are for single-family residential use only. No business, trade, or profession is allowed (except Declarant may use up to 4 homes for sales/display). No signs, placards, or posters visible from public view. No tree over 3 inches in diameter (measured at 3 ft high) may be cut, pruned, or removed without Declarant's written approval.
- Architectural & construction standards: Minimum home size is 2,000 sq ft exclusive of porches, decks, and garages. Buildings must be at least 30 ft from Arboretum Drive right-of-way. Built-upon area per lot is limited to 7,000 sq ft. A 30 ft vegetated buffer must be maintained between impervious areas and surface waters. Alterations to common areas require association consent.
- Master association (Landfall Council): In addition to the Saybrook Village HOA assessments, each owner must pay Shared Common Expense assessments and segment assessments to the Landfall Council of Associations. The Council also has rulemaking authority, and its rules prevail over the HOA's rules in case of conflict.
